Welcome to VIBEREEL! We are a mobile App designed to create a new, simple and fun way for friends to enjoy music together. Vibereel allows you and your friends to quickly and easily play songs together, check-out and share each other’s profiles, sessions and events, giving opinions and interacting with other users through the app.
This Privacy Policy is effective immediately upon you agreeing to it by clicking the “Accept” button and describes our policies on the collection, use, and disclosure of your information in connection with your use of our app, emails, and sites (“App”).
Whenever we say “we”, “us”, and “Vibereel”, we mean TOHTT SERVIÇOS DE TECNOLOGIA LTDA., a Brazilian company headquartered in Recife, in the state of Pernambuco, Brazil (“Vibereel”). When you use the App, you consent to our collection, management, use, and disclosure of your data and information as described in this Privacy Policy.
Vibereel may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your data and information and will be located at http://vibereel.com/privacy . Whenever a change in our Privacy Policy occurs, your next access to the App will present you with a notice containing its current version or a link to it, so that you are given the possibility to either accept or opt out of the App. By clicking the “Accept” button, you agree to be bound by the revised Privacy Policy.
You are aware that any information you input or authorize to or through the App may be stored by us in order to personalize your user experience, fulfill your requests, provide App functionality, improve App quality, display relevant advertising matching your profile, provide you with proper customer support, message you, back up our systems, allow for disaster recovery, and comply with legal obligations. You will need to input or authorize access to your information on the following situations:
a. Account Registration: You must either (i) provide a valid email address together with your first and last names in order to sign up for a Vibereel Account and create a password or (ii) sign in directly with your Facebook account, case in which you will also be bound to Facebook’s Privacy Policy (http://www.facebook.com/about/privacy). You are solely responsible for keeping the confidentiality of your login information and the accuracy of your personal data. When you sign up for a Vibereel account, we opt you to receive emails from Vibereel by default. You can manage your email preferences and modify some of the information associated with your account at any time. Note that you cannot opt out of receiving required administrative or legal notices. If you feel that an unauthorized account has been created depicting you or your likeness, you can request its removal (unauthorized.account@Vibereel.com).
b. Disclosure of your personal data: Your songs, playlists, photos, check-ins, check-in comments, ratings, news feed (“Vibenews”), Vibenews comments, Vibenews likes, favorites, friends, lists, account profile (including your profile photo, gender, first name and last name, but excluding your other account registration information), and other content you post to the App are, by default, meant for public consumption. We may display this content on the App, and further distribute it to a wider audience through third party sites and services. When configuring your account, you are given the possibility of choosing between two privacy settings, thus regulating the level of disclosure of the information inputted by you. That is, you may either turn the button “My Profile is Public” on or off.
In case you choose to maintain the default option “My Profile is Public” on, all of your profile information and inputs will be viewable to all other users, such as your profile photo, gender, first name and last name, comments, Vibesessions you created as a Vibemaster or participated in as a Vibeplayer and your list of songs, regardless whether you have them among your friends or not.
If, however, you turn off the “My Profile is Public” button, it means that a user will only be deemed your friend in case you expressly accept his/her friend request. Thus, only your friends will have access to and visualize your full profile, i.e. your profile picture, full name, gender, comments, Vibesessions you created as a Vibemaster or participated in as a Vibeplayer and your detailed list of songs and friends. Other users which have not been added as your friend will only have access to your profile picture, first name and last name and the amount of Vibesessions you participated in as well as the amount of friends and songs you have. However, the list and specification of the Vibesessions you participated in, songs and friends you have will not be available for users which have not been added your friend.
c. Friends: You can invite your friends to join the App by providing their contact information so that we may send them a request, or by allowing us to use your address book from your mobile device, computer or other sites like Facebook. If you invite a friend to join and connect with you on the App, we may use and store your friends’ contact information with a view to process your requests.
d. Messaging: If you exchange messages with others through the App, we may store these messages in order to deliver them and allow you to manage them. If you send information from the App to your phone via SMS text message, we may log your phone number, phone carrier, and the date and time that the message was processed. Carriers may charge recipients for texts that they receive.
In addition to the information you submit to or through the App, we, as most of the mobile service providers, also collect and store information from and about you in the course of your App related activity. We basically use this information to analyze and track your user behavior in order to personalize your experience, associate it with other information about you, provide the functionality and improve the quality of the App, help comply with legal obligations, and display relevant advertising matching your interests and profile. This information may be collected in a couple of different ways: - Cookies: We may use cookies, web beacons, local shared objects (sometimes called “flash cookies”), and similar technology in connection with your use of the App (“Cookies”). Cookies may transmit information about you and your use of the App, such as your browser type, search preferences, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. You can disable some (but not all) Cookies in your device or browser settings, but doing so may affect your ability to use the App.
Vibereel does not rent, share, license, sell or trade personally identifiable information with third parties for their direct marketing purposes. That said, please note the following: - Advertising and Third Party Cookies: We allow third parties who provide advertising related services to use Cookies, as defined above, in connection with your use of the App. As a result, they may collect and store the same type of information and use it for the same type of purposes as described for Vibereel above, and they may be able to associate the information they collect with other information they have about you from other sources. - Service Providers: Some of the services that are offered through the App are provided by third party providers. We also outsource some of our own functions to third party providers, such as technical and customer support, tracking and reporting functions, quality assurance testing. We may share information from or about you with such third party outsourced providers so that they can perform their services or complete your requests. - Aggregate Information: We may share user information in the aggregate with third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, advertisements. - Business Transfers: We may share information from or about you with subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires Vibereel or all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy. - Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (a) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) helpful to prevent, investigate, or identify possible wrongdoing in connection with the App; or © protect our rights, reputation, property, or that of our users’ affiliates, or the public. - Links: The App may contain links to unaffiliated third party websites, some of which will allow you to purchase items from their respective sites / apps, provided that you have an Account for their respective services. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third party websites. - Facebook and Google: If you are logged into Facebook, and you access but are not logged into the App, we may receive information from Facebook to make it easier for you to create an account on the App and show you relevant content from your Facebook friends. This information personalizes your experience and helps you create a Vibereel account. You can also connect your Vibereel account to your accounts on third party services like Facebook or Google, in which case we may collect and store information identifying your account with the third party service. We use the information to help you connect and share public content with your friends and followers. You can manage these settings.
If you terminate your account, we may continue to show some of your content in anonymous / “Private User’s” mode. We may also keep personal information in our active systems for a period of 5 years as of the termination date of your account (or longer if required by law) in order to ensure our ability to satisfy the authorized uses under this Privacy Policy. For example, we may use retained data to prevent, investigate, or identify possible wrongdoing in connection with the App or to comply with legal obligations. Please also note that information may exist in backup storage even after it has been removed from our active databases.
The App is intended for general audiences and is not directed to people under 18 years old. We do not knowingly collect personal information from people under 18. If you become aware that an underage user has provided us with personal information without parental consent, please report (report.abuse@Vibereel.com). If we become aware that a person under 18 has provided us with personal information without parental consent, we will take steps to remove such information and terminate the person’s account.
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
